What Happens after an Arrest?

Once the arrest has been made, the defendant will be taken to the local jail. It is at the local city or county jail where the booking process begins.

During the booking process the following procedure takes place:

  • Identity verification
  • Photographs or mug shots
  • Fingerprinting
  • Property inventory
  • Interrogation
  • Formal Charges
  • Bail Determination

The booking process, (aka receiving process) can take anywhere between 2 to 5 hours depending upon where they are held. Once the booking process is complete, we’re able to post the bond, and the defendant begins the release process. After bond has been posted and the release process begins, it take anywhere between 3 to 8 hours at the Orange County Jail, depending on the activity, and sometimes much longer.

If the defendant is held at one of the city jails, such as Anaheim Jail, Newport Beach Jail, Costa Mesa Jail, or Huntington Beach Jail, they’ll be released quickly after the bond has been  posted.

While we are involved at the begining of the arrest process, our primary concern is making sure all court appearances are made. The defendant must be present at every scheduled court hearing so as to uphold their obligation to the court. If not, the bond will be revoked by the court and a warrant will be issued for their arrest.  

Once the bond is revoked, more than likely an arrest warrant with the defendant.

Orange County Bail Schedule?

There is a set amount of bail for every criminal charge in Orange County. A “Uniform Bail Schedule” is created each year which is used by police and Sheriffs use to set bail for those arrested.  Contact us ASAP to help you figure out if bail has set for your loved one.

Cash Bonds

Posting cash bail is generally reserved for smaller bail amounts such as $1,000 or less, however, it is always an option to bypass purchasing a bail bond and deposit the full cash amount yourself directly to the jail. It requires a cashiers check made out to the “Orange County Sheriff’s Dept.” and will only be accepted during normal banking hours. Understand though that the cash you give to the jail may be held until the case is fully resolved, which could be many months or even years. Posting a bail bond often times is quicker, safer, and often times a better finance option.

 Charge Classifications

More serious charges like assault cans be classified either as misdemeanors or felonies. Each of these classifications has a series of specific classes (A, B, C, or D). Depending on the severity of the crime, it gets classified as a misdemeanor or felony, which is then given a classification.

This is not an exhaustive list of charges. All of the charges mentioned are further divided into levels of severity. That level of severity determines whether the defendant will be charged with a misdemeanor or felony.

Serious Charges

If the defendant is charged with multiple offenses, there will arraignment hearing in front of the judge.

During the arraignment, a judge has the right to revoke the bond despite the 8th Amendment of the Constitution if circumstances warrant the defendants surrender. However, this is only for extenuating circumstances.

If the judge believes that the defendant is a flight risk or a danger to society or themselves then bail can be revoked.

What to do If There's an Arrest Warrant Out for Me?

If you find out there is arrest warrant for you and before the police are able to arrest you, call us immediately, we may be able keep you out of jail!

While the urge may be to call a loved one or a friend, they won't be able to help much at this point, but we will! We can investigate the details of the arrest warrant and help you navigate the system to keep you out of custody if at all possible.

Depending on the situation, we may be able to post your bond directly at one of the Orange County Courts without you ever having to go into custody.

 Types of Orange County Bail Bonds

Whether you're in Orange County or somewhere else in California, there are seven types of bail bonds.

  • Bail Bonds (type surety bond): This is insurance you purchase which guarantees the court the full bail amount if the defendant fails to appear. These bonds require between 7%-9% of the full bail amount in premium.
  • Property Bonds: When real estate is used as a guarantee to the court and used as collateral. The county court will place a lien on a home with sufficient equity as collateral to cover the full bail amount. We are experienced experts in preparing these types of bonds, call us for a quote!
  • Cash Bail Bonds: When paying the full bail amount directly to the court which is held as collateral until the case is over.
  • Citation Release Bonds: If you've ever gotten a ticket, then you've gotten a citation release bond. They are issued at the discretion of the citing officer only.
  • Federal Bail Bonds: If the crime is on a federal level, then it may require a Federal Bond.
  • Immigration Bail Bonds: When a defendant is arrested and they have no legal status in the United States, they may end up in immiration or ICE custody. Once they go before a judge in immigration court, they may require and immigration bond to be released. Call us for details.
  • Own Recognizance Release (aka O.R. release): You are released from jail with a simple promise to appear in court on the required court dates. Typically used for less serious offenses and for those with little or no criminal history.
